(AP) ? A former Army recruiter failed to win a fourth reprieve from the U.S. Supreme Court and was executed Tuesday evening in Texas for participating in the shooting death of a woman he and a buddy met 10 years ago at a bar.

Cleve Foster was pronounced dead at 6:43 p.m. CDT, 25 minutes after his lethal injection began and two hours after the high court refused to postpone his punishment. Three times last year the justices stopped his scheduled punishment, once when he was moments from being led to the death chamber.

His attorneys argued he was innocent of the 2002 slaying of Nyaneur Pal, a 30-year-old immigrant from Sudan. They also said he had deficient legal help at his trial and in early stages of his appeals and argued his case deserved a closer look.

Foster, 48, also was charged but never tried for the rape-slaying a few months earlier of another woman in Fort Worth, Rachel Urnosky.

In the seconds before the single lethal dose of pentobarbital began, Foster expressed love to his family and to God.

"When I close my eyes, I'll be with the father," he said. "God is everything. He's my life. Tonight I'll be with him."

He did not proclaim innocence or admit guilt. He did turn to relatives of his two victims, saying, "I don't know what you're going to be feeling tonight. I pray we'll all meet in heaven."

As the drugs began taking effect and while he was repeatedly saying he loved his family, he began snoring, then he stopped breathing.

Three of the nine Supreme Court justices ? Ruth Bader Ginsburg, Elena Kagan and Sonia Sotomayor ? would have stopped the punishment, the court indicated in its brief ruling.

Last year ? in January, April and September ? the justices did intervene and halted his execution, once only moments before he could have been led to the death chamber.

"It's offensive to us the frivolous appeals that were thrown up at the Supreme Court last minute," said Terry Urnosky, whose 22-year-old daughter's death was blamed on Foster and a partner, Sheldon Hale. "One stay after another, just delaying the closure our families sought."

Urnosky, his wife, and Pal's uncle and aunt stood a few feet away from Foster and watched the execution through a window.

"It's like ripping off a deep scab each time, preventing the wound from being able to start healing," Unrosky said. "Now the wound can start closing."

Maurie Levin, a University of Texas law professor representing Foster, argued the Supreme Court needed to block it again in light of their ruling earlier this year in an Arizona case that said an inmate who received poor legal assistance should have his case reviewed

Foster and Ward were sentenced to die for killing Pal, who was seen talking with the men at a Fort Worth bar hours before her body was found in a ditch off a Tarrant County road.

"I am as certain of Foster's guilt as I can be without having seen him do it," Ben Leonard, who prosecuted Foster in 2004, said last week.

A gun in the motel room where Foster and Ward lived was identified as the murder weapon and was matched to an earlier to Urnosky's fatal shooting at her apartment.

"It wasn't the violent death that both Mary and my daughter experienced," her father said. "I feel it was way too easy, but it is what it is."

Foster blamed Pal's slaying on Ward, one of his recruits who became a close friend. Prosecutors said evidence showed Foster actively participated in her death, offered no credible explanations, lied and gave contradictory stories about his sexual activities with her.

The two were convicted separately, Ward as the triggerman and Foster under Texas' law of parties, which makes participants equally culpable. Pal's blood and tissue were found on the weapon and DNA evidence showed both men had sex with her.

At his trial, prosecutors presented evidence Pal wasn't shot where she was found; that Ward alone couldn't have carried her body to where it was dumped; and that since he and Foster were nearly inseparable and DNA showed both had sex with her, it was clear Foster was involved. A Tarrant County jury agreed, and both received the death sentence. Ward died in 2010 of cancer while on death row.

Foster grew up in Henderson, Ky., and spent nearly two decades in the Army. Records showed court martial proceedings were started against the sergeant first class and he was denied re-enlistment after allegations he gave alcohol to underage students as a recruiter in Fort Worth and had sex with an underage potential recruit. He'd been a civilian only a short time when the slayings occurred.

iPhone 5 launch draws Apple fans worldwide

Catheryne Caveed, 23, was in line at a Verizon store in the Queens borough of New York. An iPhone 4 user, she had no regrets about skipping last year's model, the iPhone 4S. The only real upgrade in the 4S, she said, was Siri, the voice-controlled "personal assistant."

"The 4S looked the same as the 4," Caveed said. With the 5, "everything is different ? even the headphones."

Apple's stock closed up $1.39, or 0.2 percent, at $700.09. The stock surpassed the $700 level for the first time earlier this week, as excitement for the launch mounted.

For Apple, the iPhone introduction is the biggest revenue driver of the year. Analysts expect the company to sell millions of phones in the first few days. This spring, iPhone sales slowed down from their historical growth rates, apparently because potential buyers were holding off for the arrival of the "5."

Apple now needs to sell tens of millions of phones before the end of the year to justify its position as the world's most valuable public company. Although Samsung Electronics Inc. of Korea sells more smartphones, Apple's iPhone profits are far greater.

In London, some shoppers had camped out for a week in a queue that snaked around the block. In Hong Kong, the first customers were greeted by staff cheering, clapping, chanting "iPhone 5! iPhone 5!" and high-fiving them as they were escorted one-by-one through the front door.

The smartphone went on sale in the U.S. and Canada hours after its launch in Australia, Japan, Hong Kong, Singapore, Britain, France and Germany. It will launch in 22 more countries next week. The iPhone 5 is thinner, lighter, has a taller screen, faster processor, updated software and can work on faster "fourth generation" mobile networks.

The handset has become a hot seller despite a new map app that early users have deemed inferior to Google Maps, the software it replaces. Apple received 2 million orders in the first 24 hours of announcing its release date, more than twice the number for the iPhone 4S in the same period when that phone launched a year ago.

In a sign of the intense demand, police in Osaka, Japan, were investigating the theft of nearly 200 iPhones 5s, including 116 from one shop alone, Kyodo News reported. In London, police sought help finding a man wanted in connection with the theft of 252 iPhone 5s from a shop in Wimbledon early Friday morning.

Analysts have estimated Apple will ship as many as 10 million of the new iPhones by the end of September.

Some fans went to extremes to be among the first buyers by arriving at Apple's flagship stores day ahead of the release.

In downtown Sydney, Todd Foot, 24, showed up three days early to nab the coveted first spot. He spent about 18 hours a day in a folding chair, catching a few hours' sleep each night in a tent on the sidewalk.

Foot's dedication was largely a marketing stunt, however. He writes product reviews for a technology website that will give away the phone after Foot reviews it.

"I just want to get the phone so I can feel it, compare it and put it on our website," he said while slumped in his chair.

In Paris, the phone launch was accompanied by a workers' protest ? a couple dozen former and current Apple employees demonstrated peacefully to demand better work benefits. Some decried what they called Apple's transformation from an offbeat company into a multinational powerhouse.

But the protesters ? urged by a small labor union to demonstrate at Apple stores around France ? were far outnumbered by lines of would-be buyers on the sidewalk outside the store near the city's gilded opera house.

Not everyone lining up at the various Apple stores was an enthusiast, though. In Hong Kong, university student Kevin Wong, waiting to buy a black 16 gigabyte model for 5,588 Hong Kong dollars ($720), said he was getting one "for the cash." He planned to immediately resell it to one of the numerous grey market retailers catering to mainland Chinese buyers. China is one of Apple's fastest growing markets but a release date for the iPhone 5 there has not yet been set.

Wong was required to give his local identity card number when he signed up for his iPhone on Apple's website. The requirement prevents purchases by tourists including mainland Chinese, who have a reputation for scooping up high-end goods on trips to Hong Kong because there's no sales tax and because of the strength of China's currency. Even so, the mainlanders will probably buy it from the resellers "at a higher price ? a way higher price," said Wong, who hoped to make a profit of HK$1,000 ($129).

A similar money-making strategy was being pursued in London, where many in the crowds ? largely from the city's extensive Asian community ? planned to either send the phones to family and friends back home as gifts or sell them in countries where they are much more expensive.

"It makes a really nice gift to family back home," said Muhammad Alum, 30, a minicab driver from Bangladesh. "It will be two or three weeks before there is a SIM card there that can work it, but it's coming soon."

Others who had waited overnight said the iPhones cost roughly twice as much in India as in Britain, making them very welcome as gifts.

Tokyo's glitzy downtown Ginza district not only had a long line in front of the Apple store, but another across the main intersection at Softbank, the first carrier in Japan to offer iPhones.

Hidetoshi Nakamura, a 25-year-old auto engineer, said he's an Apple fan because it's an innovator.

"I love Apple," he said, standing near the end of a two-block-long line, reading a book and listening to music on his iPod.

"It's only the iPhone for me."

Spain's Rajoy studies rescue, says may not be necessary

MADRID/HELSINKI (Reuters) - Spain continues to study the price it will have to pay for seeking help from the European Central Bank's bond-buying program but improved market conditions may make aid unnecessary, Prime Minister Mariano Rajoy said on Wednesday.

"I don't know if Spain needs to ask for it," Rajoy told parliament in a debate session, referring to an international rescue for Spain.

Yields on Spanish bonds have fallen dramatically, to five-month lows, since the ECB agreed last week to launch a new bond-buying program to reduce struggling euro zone countries' borrowing costs provided they first request assistance from the euro zone's rescue fund and abide by strict conditions.

Earlier, in an interview with Finnish newspapers, Rajoy said he had no objection to the International Monetary Fund monitoring Spanish compliance with the conditions for any assistance although he has also insisted that no fresh demands should be made on Spain in terms of cutting debt.

"The IMF is already monitoring our economy," Helsingin Sanomat quoted Rajoy as saying during a visit to Madrid by Finnish Prime Minister Jyrki Katainen on Tuesday.

Spain, which has already secured European rescue funds of up to 100 billion euros ($128.5 billion) for its troubled banks, is also struggling with its fiscal deficit, indebted regions and pressure from credit rating agencies.

"In addition to growth, the only option I am considering is using the central bank's announced mechanism," Rajoy said, according to Helsingin Sanomat.

"It is completely ruled out that we would ask for a bailout for the whole country," he told business daily Kauppalehti.

His comments indicated Spain may apply for a precautionary assistance program under which the euro zone's rescue funds could buy Spanish bonds as they are auctioned without the country being taken off the credit markets, rather than the kind of full sovereign bailout granted to Greece, Portugal and Ireland.

The conditions on a precautionary program would be lighter, and the cost to the rescue funds of supporting the euro zone's number four economy would be lower.

Germany is pushing for tougher conditionality than merely implementing the existing European recommendations that Spain slash its public deficit and reform its economy to make it more competitive.

Even in a "bailout-lite scenario," an IMF role in helping frame conditions and supervise compliance would be more intrusive than its current level of involvement.

Rajoy repeated that his government would carefully study the strings attached to the ECB's bond program, but added he would not be told what to do with the budget.

"I am prepared to decrease the deficit. But others cannot decide how it will be reduced," he said.

Rajoy said in a television interview on Monday he would not touch the pension system, although many economists believe reducing unsustainable pension costs would be a likely condition for any assistance program.

NEW YORK (AP) ? A new and uncertain era of e-book prices has begun.

HarperCollins Publishers announced Tuesday that it has reached new price agreements with sellers that conform to a settlement with the Justice Department over allegations that five publishers and Apple colluded to set prices for e-books. Such new works as Michael Chabon's "Telegraph Avenue" now can be purchased on Amazon.com for $9.99, a price publishers and rival booksellers fear will give Amazon dominant control of the e-market.

Simon & Schuster and Hachette Book Group also settled, but as of Tuesday afternoon e-prices for such fall books from those publishers as Bob Woodward's "The Price of Politics" and Tom Wolfe's "Back to Blood" were selling for $14.99. A spokesman for Simon & Schuster declined comment, while Hachette issued a statement saying it was "engaged in productive discussions with e-book distribution agents."

Apple and two other publishers, Penguin Group (USA) and Macmillan, declined to settle and a trial is expected next June.

The settlement was announced in April, when the Justice Department filed suit, and was approved last week by a federal judge in New York. The legal action stems from agreements reached between major publishers and Apple in 2010 that allowed publishers to set their own prices for e-books, an effort to counter Amazon's deep discounts of best sellers. Over the past two years, Amazon's e-share is widely believed to have dropped from around 90 percent to around 60 percent, with Barnes & Noble.com's rising to 25 percent.

E-books are believed to comprise around 25-30 percent of total sales, exponentially higher than four to five years ago. But growth has slowed over the past year, and reasons cited vary from the higher prices charged under the Apple agreements to a general maturation of the e-market, with the most avid e-book readers already accounted for.

With no definitive resolution expected soon, publishers and booksellers face a complicated time of possible price wars or periods when books may become unavailable during the busy fall season, depending how quickly new agreements are signed. Barnes & Noble.com and other online retailers may feel pressure to cut their prices as deeply as Amazon.com. And Random House Inc., which agreed to a similar sales model as HarperCollins and others but is not involved in the legal action, may find itself charging several dollars more for popular e-books than its competitors charge

Prices for new HarperCollins books differed from seller to seller as of Tuesday afternoon. Chabon's "Telegraph Avenue" cost $12.59 on Barnes & Noble's Nook and $9.99 on Apple's iBookstore. Molly Ringwald's "When It Happens to You" was $9.74 on Amazon, $12.99 on Barnes & Noble and $9.99 on Apple.

OAKLAND, Calif. (AP) ? Athletics pitcher Brandon McCarthy left in the fourth inning of Wednesday's 7-1 loss to the Los Angeles Angels after Erick Aybar's hard line drive ricocheted off the right-hander's head.

McCarthy was taken to Alta Bates Summit Medical Center in Oakland as a precaution, and the team said doctors wanted him to stay overnight for further observation. The A's also announced McCarthy would not travel with the team to Seattle on Thursday.

McCarthy had almost no time to react when Aybar lined his 91-mph cutter back up the middle. The ball bounced off the right side of McCarthy's head, knocking him down. He also landed on his head on the infield grass.

Third baseman Josh Donaldson picked up the deflected ball and threw to first for the second out of the inning.

McCarthy curled up in a ball and was writhing in pain. Team trainers checked on McCarthy for several minutes as A's players huddled around the infield and on the top step of the dugout.

Aybar stood on first base and looked on with concern. He was later seen in the Angels' dugout sitting with his head down and his hands over his head.

McCarthy eventually sat up and ran his hands through his hair and around his head. He walked off the mound under his own power to an ovation from the Oakland Coliseum crowd.

McCarthy left with Oakland trailing 3-1. He allowed five hits, struck out three and walked one intentionally. Travis Blackley entered in relief.

McCarthy, Oakland's opening-day starter, is 8-6 with a 3.24 ERA in 18 starts this season.

The Brody File | Dems Add God, Pro-Israel Language Back into Platform


Now an update to the story that The Brody File first broke across the country: God is back.

This has become a disaster for the Democrats and a boon to the Romney campaign. The DNC has now added God back into their platform language after originally taking it out. They have also added language back in that says Jerusalem is the capital of Israel. When they tried to change the language on the convention floor, there were boos! Oy-gevalt.

Despite the corrections by the Democrats, the Romney campaign can now argue that the Democrats don't know what they believe on two very important topics. They can also argue that the Democrats only did this because of the pushback. That?s true. The Brody File first pointed it out and the media followed, making this a story that the DNC wants to make go away. The problem is it?s not going away. Expect the Romney campaign to push this until Election Day. These last second changes really just make the issue worse and make the Democrat Party look bad.

In a way it?s unfortunate for the party because speakers at the DNC have been talking about God from the stage and there have been plenty of faith-filled events down here in Charlotte. But party officials should have known this would get scrutinized. The issue is either political malpractice or something far worse.

Democrats have changed their convention platform to add a mention of God and declare that Jerusalem is the capital of Israel.

The move came after criticism from Republicans.

Many in the audience booed after the convention chairman, Los Angeles Mayor Antonio Villaraigosa, ruled that the amendments had been approved despite the fact that a large group of delegates objected.

He called for a vote three times before ruling.

The party reinstated language from the 2008 platform that said "we need a government that stands up for the hopes, values and interests of working people and gives everyone willing to work hard the chance to make the most of their God-given potential."

The platform also now includes what advisers said was Obama's personal views on Jerusalem.

When this is not the case, the exact way cancer cells originate in prostate tumors was not clear until now. Scientists were able to show that the genesis of this fusion-negative prostate cancer has epigenetic causes: methyl groups are distributed differently over the DNA in the cancer cells than in healthy cells. Thanks to this knowledge, physicians may be able to achieve greater specificity in treating prostate tumors in future. In addition, the aberrant DNA methylations can be used as a potential biomarker for identifying prostate cancer.

There is hardly a schoolchild who is not familiar with haiku, the Japanese art of the tiny poem, constructed out of three lines of 5-7-5 syllables and traditionally evoking images from nature. But while an understanding of haiku is often left at that, its legacy in art and literature is decidedly more complex. In The Art of Haiku, Stephen Addiss illuminates how haiku evolved in the hands of its masters, stretching from the eighth century to the 12th. He purposefully juxtaposes the well-known poetic form with its less famed artistic counterparts: paintings, called haiga, and calligraphy. Fully formed haiku was meant to be experienced both visually and textually. This uncommon book gives us the chance to do just that.

Addiss is the right man to author ?The Art of Haiku.? He is not only a leading haiku scholar, but also a practicing artist who has exhibited ink paintings and calligraphy around the world. He translates from Japanese, and has a lengthy list of publications. Fittingly, as haiku has its roots in song, Addiss traveled the world as part of the folk music duo Addiss & Crofut. He studied music at Harvard University and, with composer John Cage, at the New School in New York. He didn?t begin his graduate work on East Asia until he was in his late thirties.

Fascinating as Addiss himself is, he keeps out of the spotlight in ?The Art of Haiku.? The book is a steady narration on the emergence of haiku, beginning with the courtly tradition of tanka (five-line poems ? or songs ? of 5-7-5-7-7 syllables) and evolving into new forms, including haiga, haikai (comic verse), and renga, where two or more poets go back and forth to create a chain of linked tanka, shaped by a range of curious rules. ?Chinese-derived words were frowned upon, but seasonal references should be included in roughly half the segments [?],? Addiss informs us.?Some words could only appear once in a thousand verses, including the words for demon, tiger, dragon, and woman.

The book is rich with poems ? 997 haiku, nearly all translated by Addiss and integrated easily with the text alongside transliterated Japanese originals. Particularly fascinating is the discussion of haiku translation. Idiosyncrasies in the originals, such as pause marks called kijeri (literally, cutting words) leave room for translators to make judgment calls on how to evoke rhythm or amplification. Addiss encourages readers to sound out the Japanese originals ? and provides the tools to do so ? to hear the music, and he does so with a grace that does not undercut the worth of the gorgeous English versions. He arms readers with a wealth of context on how, for example, the Japanese word for ?color? and ?passion? is the same. Like the art of haiku itself, Addiss invites readers into the poems, amplifying them with their own experiences and, in a way, collaborating with the poet to complete the poem.

There is even an appendix on translation, which sets forth yet more choices in moving haiku between Japanese and English. Addiss presents a haiku by Chiyo in Japanese and lists each word with its literal meaning before indicating that, ?Now it is up to you: Will you try to make this a 5-7-5 poem in English? Will you change the line order? Will you use any plurals? What words and rhythms in English do you think can convey this scene best??

What might seem gimmicky is actually an endearing manifestation of how Addiss writes this book as a meeting-of-equals between author, readers, artists, and poets. And what company to keep! There is Lady Murasaki, author of ?The Tale of Genji? (probably the world?s first novel), whose title character trades whispered tanka with his wife. There is Saigy? H?shi, who leaves his luxurious life in the imperial guard to become a Buddhist monk and write searing poems of transience. There is Yosa Buson, the master especially skilled in haiga (he knew it, too). His paintings reproduced here are drawn so simply and sweetly, they look like the figures of comics: emotion is evoked in just a few lines (which is, of course, the same formula for haiku). Kobayashi Issa funneled a tragic life into tiny potent verses. And of course there is Bash?, the wandering poet who, as Addiss puts it, is to haiku what Shakespeare is to theater and Michelangelo is to sculpture.?

There are times when the clear language of ?The Art of Haiku? turns bland, more like the rote recitation of a lecturer than a writer delving into poetic treasures. Addiss? thorough explanations subdue his enthusiasm: when he does break the even tone to describe a poem as ?charming? or ?powerful,? it is hard to feel any heat behind it. There are needless textual repetitions that add to the classroom feel ? the interesting bit about ?color? and ?passion? being the same word in Japanese is mentioned three times in eight pages. At its worst, one wonders at the dissonance between the textbook language and the heart-opening art it means to conjure.

At its best, however, Addiss? strategy of keeping his own voice muffled (he uses the pronoun ?we? rather than ?I?) creates room for the ambitious scope of ?The Art of the Haiku,? allowing several centuries worth of poets and artists to hold court without distraction. And, indeed, there they shine.

Hong Kong students protest over 'brainwashing' classes

Hong Kong students and teachers protested Tuesday for a sixth straight day against plans to introduce Chinese patriotism classes, as political tensions rise days ahead of legislative polls.

Protesters at the government headquarters said they would not vote for parties that supported "national education", which they say is a bid to brainwash children with Chinese Communist Party propaganda.

"I feel national education is an important issue because it could affect many generations of children's education," second year university student Cheung Nga-lam said at the demonstration, which began on Thursday.

"The new Legislative Council members will definitely have an influence on the issue because whatever they say affects society."

The former British colony goes to the polls on Sunday to elect a new 70-seat legislature, but power will continue to reside with the pro-Beijing executive appointed by Chief Executive Leung Chun-ying.

Leung has ignored protesters' calls for a meeting and refused to abandon plans to implement the new education policy, which schools can adopt voluntarily from this week and will become compulsory by 2016.

"We are willing to talk to the anti-national education parties, but the prerequisite of the dialogue cannot be either to withdraw or not to withdraw," Leung told reporters.

Most schools have said they will not introduce the subject this year and want to see more details about how it should be taught.

The government says the curriculum is important in fostering a sense of national belonging and identity, amid rising anti-Beijing sentiment in the semi-autonomous southern city of seven million people.

But critics say the lessons extol the virtues of one-party rule and gloss over events like the bloody Tiananmen crackdown on pro-democracy protesters in 1989, and the mass starvation and extrajudicial killings of Mao's Cultural Revolution.

The protests have swelled in number from a few hundred in the mornings when students are in class, to several thousand at night. Up to 40,000 joined the rally on Saturday despite heavy rain, organisers said.

It was the second mass demonstration against the education policy in two months, after up to 90,000 people took to the streets in July.

A handful of students and teachers have gone on hunger strike to drive home their opposition to the plan. One woman was hospitalised on Tuesday after refusing to eat for several days.

There have also been calls for teachers and students to boycott classes.

"People are extremely interested in this issue so it is impossible for it to be discussed behind closed doors by a small representative body," said hunger striker Wong Hak-lim, a 56-year-old high school vice-principal.

Democratic Party lawmaker James To called on Leung to "immediately withdraw the package".

"It's my view that the government isn't genuine and really wants to brainwash children because they think the Hong Kong people aren't patriotic enough," he said at an election forum on Monday.

Hong Kong returned to Chinese rule in 1997 but maintains its own independent legal system which guarantees civil liberties not seen on the mainland.

(AP) ? Egypt's president says Syrian leader Bashar Assad must learn from "recent history" and step down before it is too late.

Mohammed Morsi's reference to "recent history" appeared to allude to the fate of authoritarian regimes in Tunisia, Libya, Egypt and Yemen that have been overthrown by Arab Spring uprisings.

Morsi spoke Wednesday at a meeting of Arab foreign ministers in Cairo.
