Can a Motorola X Phone keep up with Apple and Samsung?

The Wall Street Journal reported Friday that Motorola is hard at work on an 'X Phone,' a flagship smart phone that would stand out from handsets made by Apple and Samsung. But 'X Phone' development may be running into some early obstacles.

When Google purchased Motorola last year for $12.5 billion, there was lots of speculation about what was behind the deal. Was Google only interested in Motorola?s portfolio of patents? Or did it hope to put the company?s engineers to work on its own projects?

New rumors suggest that it?s largely the latter: The Wall Street Journal reported Friday that Motorola is hard at work on a flagship Android phone known internally as the ?X Phone,? to be released some time in 2013. Citing ?people familiar with the matter,? the Journal says the X Phone is designed to stand head and shoulders above current handsets, although engineers are running into some early obstacles.

Motorola and Google apparently have big plans for the X Phone: Motorola is investigating materials that would make the display more flexible and less likely to crack or break under pressure, and the company wants to include better camera software and gesture recognition while simultaneously boosting battery life. It?s too early to speculate on the size of the phone or the features it will include, but the Journal?s sources say Motorola will also begin building an X Tablet once the phone has been completed.

The X Phone would run what?s known as ?vanilla? Android: a pure version of the OS that comes directly from Google. Right now only the Nexus line of phones, including Samsung?s popular Galaxy Nexus, run vanilla Android; all other handsets have extra code added by manufacturers, like Samsung?s ?TouchWiz? UI or HTC?s ?Sense.? Lots of users find these additional features helpful, but others prefer the flexibility of being able to use a version of Android that doesn?t have the manufacturer?s ?stamp.?

But along with developing the X Phone, Google and Motorola have to carefully navigate their delicate relationships with other companies that make Android handsets -- especially Samsung. Samsung has become the biggest smart phone maker in the world, thanks in no small part to a warm relationship with Google -- but it?s also a rival to Motorola. Google wants to boost Motorola?s sales (Motorola commands an anemic 3 percent of the Android phone market, compared to Samsung?s 40 percent) but doesn?t want to jeopardize its relationship with Samsung or other manufacturers.

By the way, if you own one of Motorola?s existing Droid phones, don?t worry: the company will continue to produce them for Verizon, its carrier partner, as well as devoting resources to developing the X Phone. In spite of poor sales, many of the Droid phones Motorola released in 2012 were well-received by critics.

More gun laws on the way in California?

SACRAMENTO -- Even with the nation's toughest gun control laws, some California legislators are seeking more restrictions following last week's deadly Connecticut shooting rampage that took the lives of 20 young children and seven adults.

Among at least four proposals, one would prohibit semi-automatic weapons like AR-15s and AK-47s from having devices known as "bullet buttons," which allow easy reloading of multi-bullet ammunition clips. Sen. Leland Yee, D-San Francisco, introduced a similar bill last year that died in the Assembly. His proposal would also prohibit add-on kits to adapt weapons for high-capacity bullet clips.

"While we cannot stop every senseless act of gun violence, surely we can strengthen our laws to limit such tragedies in the future," Yee said.

Other bills would require annual permits for ammunition purchases, mandate school safety plans and permanently deny weapons to mentally ill people.

Gun-control advocates say that a climate of permissive gun laws has made the United States one of the most violent countries in the developed world. Gun-rights groups maintain that citizens with appropriate weaponry can prevent tragedies such as the Newtown shooting because the "good guys" can kill gunmen at the first sign of a shooting spree.

California goes beyond federal law in requiring background checks on individuals who try to buy firearms at gun shops and gun shows. It also requires a 10-day waiting period for

handgun and rifle purchases.

The state has approved 45 gun-control laws since 1989, when the state became the first in the nation to ban military-style assault weapons after the slaying of five children and wounding of 29 others in a Stockton schoolyard.

Yee plans to push another bill to require yearly registration and background checks for gun ownership.

Another bill, by Sen. Kevin DeLeon, D-Los Angeles, would require a background check and permit ? with annual updates -- for anyone wishing to buy ammunition.

"For the sake of our children and the memory of the victims of the Sandy Hook massacre, it's time for an honest and rational debate on gun control and how to keep ammunition out of the hands of criminals," De Leon said.

Sen. Ted Lieu, D-Torrance, is relaunching a bill to firm up the school safety laws by requiring schools to establish emergency-response plans for eruptions of violence on school grounds.

"President Obama stated our first task is to care for our children," said Lieu, whose two young sons attend a public elementary school. "When children attend public school, they are in the care of the state and we better make sure they are as safe as possible."

The state does not have accurate figures on how many public schools have school-safety plans that outline emergency steps, Lieu said.

Republicans are generally opposed to gun-control laws, but Sen. Ted Gaines, R-Roseville, has a bill to keep firearms permanently out of the hands of the mentally ill.

California prohibits gun possession for anyone with a mental disorder who is found by a court to be a danger to others, or for those deemed as mentally disordered sex offenders. But, people with mental disorders can seek court approval for gun permits later. Gaines' bill would forbid them from petitioning the courts to have a gun.

"I hope everyone with any mental illness gets the treatment and rehabilitation they need to live a healthy and productive life," Gaines said. "But if the court has ruled you are a danger to others, that's it. That is your one strike. We are not going to pave the way for you to own a firearm ever again."

Former Jackson High School Coach Set To Plead Guilty Over Nude Videos

CANTON, Ohio (AP) ? Prosecutors have been told to expect a guilty plea from a former high school basketball coach charged with videotaping nude boys in the locker room over an eight-year period, a prosecutor said Tuesday.

The attorney for Scott Studer, 46, signaled the plans to plead guilty to eight counts of illegal use of a minor in a nudity-oriented material or performance, Assistant Stark County prosecutor Chryssa Hartnett said.

She declined to comment pending Wednesday?s court hearing.

Studer?s attorney, James Haupt, couldn?t be reached for comment. A message was left at his office Tuesday.

The pending guilty plea, first reported by The Repository in Canton, involves all eight counts of the indictment returned against him, Hartnett said.

The prosecution hasn?t offered leniency or any other consideration in return for a guilty plea, she said. Studer could face 64 years in prison and the sentence will be up to the judge, Hartnett said.

Studer coached at Jackson High School near Canton and was arrested after investigators searched his home and found nude images on a DVD, a computer and a flash drive. He quit the day he was arrested last month.

Following through on its mission to help digitally preserve the Dead Sea Scrolls, Google announced today that it's working with the Israel Antiquities Authority to bring more ancient text to the cloud. The latest archived entries include an early copy of the Book of Deuteronomy and part of the first chapter of Genesis, which describes the creation of the world. In addition, hundreds of other 2,000 year-old texts outlining the history of Judaism and the life of Jesus will be added to the Leon Levy Dead Sea Scrolls Digital Library at a 1,215 dpi resolution. Utilizing Google's hosting, this project houses around 900 manuscripts that support commenting, image zoom and fullscreen viewing. Recent Trends in Class Actions for Telephone and Fax Solicitation ...

Class actions under the Telephone Consumer Protection Act (TCPA), 47 U.S.C. ? 227, continue to be an active trend in consumer and privacy class action litigation. The TCPA, which was historically called the "fax blast" statute, prohibits unsolicited faxes and automated calls for the purpose of commercial solicitation. The TCPA has a statutory penalty provision that allows consumers to recover $500 for each violation and up to $1,500 for violations found to be willful and knowing. The ability to collect far more in statutory penalties than the actual damages caused by a given violation (often pennies for ink and paper) makes TCPA violations an appealing target for enterprising plaintiffs' class action lawyers. The aggregation of thousands of claims together can create huge monetary exposure for defendants and the potential for easy settlements and the large contingent fees that come with them.

FEDERAL JURISDICTION OVER TCPA CLAIMS

Arguably the most significant development in TCPA litigation this year was the United States Supreme Court's decision in?Mims v. Arrow Financial Services, LLC, which held that TCPA claims arise under federal law and may be asserted in federal court even absent diversity of citizenship jurisdiction. Prior to?Mims, the federal circuits disagreed over whether the TCPA provided for federal question jurisdiction or whether jurisdiction was limited to state courts and federal suits brought or removed on diversity jurisdiction. The Court resolved the issue in favor of federal jurisdiction, finding that "federal and state courts have concurrent jurisdiction over private suits arising under the TCPA." Because of?Mims, plaintiffs now have the option of bringing TCPA suits in state court or federal court, even in the absence of diversity jurisdiction.

Mims?also has important implications for companies defending TCPA claims. Prior to Mims, defendants had some success arguing that state laws limiting class actions -- such as ? 901(b) of New York's Civil Practice Law and Rules, which prohibits class actions for claims seeking statutory penalties -- were applicable in federal TCPA actions. Where successful, those arguments meant that federal diversity jurisdiction over the class action was trumped by state laws prohibiting certain types of class actions. In the wake of?Mims, however, some federal courts have rejected these arguments, finding that federal substantive and procedural law apply to TCPA claims in federal court. In one recent opinion with extensive analysis on the issue, the United States District Court for the District of New Jersey concluded in?Bais Yaakov of Spring Valley v. Peterson's Nelnet, LLC?that federal courts are not required to follow state laws in adjudicating TCPA claims.

The?Mims?decision is also impacting the statute of limitations defense to TCPA claims. Because of the peculiar nature of the TCPA, courts have historically split over whether a state or federal statute of limitations applies. In?Giovanniello v. ALM Media LLC, the Second Circuit answered this question and held that a shorter state-law limitations period applied rather than the four-year federal catchall provision. However, the Supreme Court granted certiorari, and recently vacated that decision and remanded for further consideration in light of?Mims. In one decision following?Mims, the United States District Court for the Eastern District of Pennsylvania, in?Hawk Valley, Inc. v. Taylor, reached the conclusion that the federal limitations period applies.

CLASS ACTIONS UNDER THE TCPA

Another major issue being litigated is whether TCPA claims are suitable for class action treatment at all. Several decisions have highlighted a split among both the state and federal courts on class action suitability. Of particular note is the decision of the New Jersey Superior Court, Appellate Division in?Local Baking Products, Inc. v. Kosher Bagel Munch, Inc., which provides an excellent survey of the various state and federal court decisions on both sides of the issue. The court in Local Baking Products ultimately decided that class certification of TCPA claims was not appropriate. It reasoned that class actions are not a superior procedure for enforcing the TCPA because Congress had made statutory penalties available so that individuals would be incentivized to pursue vindication of their rights in individual actions in small claims or other state courts. In addition to lack of superiority, a common reason offered by other courts for rejecting TCPA class certification is that the question of whether faxes or calls were authorized is too individualized for common questions to predominate.

A Supreme Court of Kansas decision upholding a lower court's decision granting class certification in a TCPA case illustrates the other side of the split on certification issues. In?Critchfield Physical Therapy v. The Taranto Group, Inc., the court rejected both the argument that individual actions in small claims court would be superior to a class action and the argument that the question of consent was too individualized. In addition, the court rejected the argument that class actions would not be superior in light of the threat that aggregating thousands of individual statutory penalties together could create an "annihilating" judgment against the defendant that would be disproportionate to any harm to the class.

The increase in automated dialing technology and cellular telephone prevalence is also giving rise to new substantive and class certification issues in TCPA cases. With respect to cell phones, one new issue is whether consent to receive calls on a particular cell phone number applies to subsequent holders of that cell phone number. For example, if person A consents to receive calls from company X on a certain cell number, can company X continue to call that number with TCPA impunity even though the number is later assigned to different people? In May, the Seventh Circuit answered no, holding that simply providing a company with a cell number does not authorize perpetual calls to that number after it has been reassigned to someone else.?Soppet v. Enhanced Recovery Co., LLC.Consent to receive calls on a cell phone has also been an issue in the class certification context. For example, the Ninth Circuit recently found that individualized issues of consent to receive calls did not preclude a finding of typicality and commonality for purposes of certifying a class.?Meyer v. Portfolio Recovery Associates, LLC.

TCPA CLAIMS BASED ON TEXT MESSAGING

TCPA claims based on text messages sent to cell phones are also a major trend today. Although the TCPA does not expressly reference text messages, the Federal Communications Commission and courts have consistently interpreted the term "call" in the TCPA to include SMS and MMS text messages. E.g.,?Satterfield v. Simon & Schuster, Inc.?Defendants have argued that claims based on text messages are not suitable for class action treatment because each plaintiff would have to show individually that she was charged for the text sent to her cell phone. Some courts have rejected this argument, finding that the TCPA does not require plaintiffs to show that they incurred charges for text messages sent to their phones.?E.g., Agne v. Papa John's Intern., Inc.

THIRD PARTY LIABILITY AND PENDING FCC INTERPRETATION

Finally, a major issue applicable to virtually any company that uses telephone, text or fax marketing is whether and to what extent a company can be liable under the TCPA for calls made (or faxes or texts sent) by third parties. This issue typically arises where a company is sued for TCPA violations but the actual caller or faxer was a marketing company, franchisee or independent agent. In some cases, the relationship can be even more removed, for example, where a company's independent contractors hire marketing firms that then hire separate telemarketing firms, which actually make the calls.

In most decisions to date, courts have held that vicarious liability of this sort is possible under the TCPA, and that there is no bright-line limit on how far is too far removed to impose liability. Most courts have tackled the issue under a traditional agency analysis. A recent decision from the United States District Court for the Northern District of West Virginia,?Mey v. Pinnacle Sec., LLC, is a good example of the prevailing analysis. The?Mey?court stated that the defendant could be liable for calls made by its lead-generating company if the lead company "acted as an agent" and the defendant "controlled or had the right to control them and, more specifically, the manner and means of the [solicitation] campaign they conducted."

Significantly, however, the?Mey?court also recognized that a more strict form of liability might be possible under the TCPA. Certain sections of the TCPA allow consumers to sue for calls made by or "on behalf of" an entity. The meaning of this "on behalf of" language is currently the subject of a Joint Petition for Declaratory Ruling before the Federal Communications Commission, on which the FCC has solicited public comments. One interpretation advocated in the public comments is an agency analysis similar to what the courts have done to date. Another, however, is a strict liability approach that would impose liability on any party that "benefits from" the offending communication, even absent knowledge or direction. If adopted, this strict liability approach could significantly increase exposure for companies because liability could be imposed even without the companies' knowledge that calls were made, or faxes or texts were sent, in the company's name. The FCC has not yet issued a ruling on the issue.

President Benson talked about the widows and mothers who for various reasons need to work outside the home and support themselves, and said, ?But these instances are the exception, not the rule.? I think still too often even women of the church want think that this means it is perfectly acceptable to have a career. Whereas I don?t think it is necessarily wrong, I still think a woman should be in the home raising and loving her children and ready to be at hand to them.?

To those who have not yet married or had children or who cannot have children:

Sister Sheri Dew has not had the chance to marry nor have children. She is a big example to me of a righteous sister in Zion. Side note, one of my absolute favorite books is by her called, ?No One Can Take Your Place.? Such a good read!! Back to motherhood here are some of her words:

?both God the Father and Adam called Eve ?the mother of all living? ? and they did so before she ever bore a child?.It is the essence of who were are as women. It defines our very identity, our divine stature and nature, and the unique traits our Father gave us.??

ANALYSIS: Egypt military keeps close eye on politics

Updated at 7:25 a.m. ET: CAIRO -- Many hailed the emergence of civilian rule in Egypt when then recently elected Islamist President Mohammed Morsi ordered the country?s armed forces back to their barracks in August, after they had led the county for close to a year and a half.

But within months, the same military was functioning as the country's auxiliary police force, ensuring the safety and integrity of the upcoming constitutional referendum, and protecting the presidency ? both physically by guarding the palace and politically by acting as an intermediary to diffuse political tensions between Islamists and the opposition.

Meanwhile, the newly drafted and disputed constitution that will be up for a vote on Saturday changes little about the military's role in the state. In fact, it preserves the ability of the military to try civilians in military courts. It also maintains the secretive budget of the armed forces, which eats up a sizable chunk of the state?s coffers.

So, as Egypt lurches through a crisis pitting the country's president and his Islamist supporters against opposition forces, observers are working to figure out what exactly the country?s powerful military will do next.

Egyptian leader told: 'Fear God... postpone the referendum'

The dispute over a controversial decree giving Morsi near absolute powers reached a crescendo on Dec. 11, when protesters opposing the president's decision circled the presidential palace. Morsi supporters, mainly from the Muslim Brotherhood and other Islamist parties, took to the streets in counter protests. They, too headed to the palace, only this time to confront the president?s opponents. What ensued were deadly clashes that left at least eight people dead and more than 700 injured.

NBC's Ayman Mohyeldin is outside the presidential palace in Cairo where hundreds of thousands are protesting what they say is an unjust constitution. They want to delay a vote on the current draft of the constitution now scheduled for December 15.?

Amid the turmoil and after standing on the sidelines, the powerful armed forces weighed in and issued their first political statement since Morsi was elected on June 24.

ANALYSIS: Egypt is rapidly approaching its own 'cliff'

?Anything other than [dialogue] will force us into a dark tunnel with disastrous consequences, something which we won't allow to happen,? the statement read. The call for dialogue may have struck some as a surprise because it came from an institution that served as the backbone of the country's authoritarian regimes for six decades.


Then late?Sunday night, Morsi issued a decree granting the country's military law enforcement powers, essentially giving the armed forces the legal authority to act as the country's police force. The military was allowed to arrest and detain civilians in the run up to the key constitutional referendum starting Saturday. It was also tasked with securing the thousands of polling stations around the country, meaning its job was to secure the integrity and safety of the voting process and the voters.

The move has drawn sharp criticism from Human Rights Watch, an international organization, which said the military's emergence as a law enforcement authority raises serious human rights concerns.

Egypt army gets temporary power to arrest civilians ahead of referendum

Islamist forces, however, remain skeptical of the military. After all, for decades it was the country's senior internal security leadership in conjunction with the military that hunted down Islamist leaders, jailing them and torturing them under strongman Hosni Mubarak and his predecessors.

Opponents of Egypt President Morsi say he's betraying the revolution, but his supporters say he wants to guarantee human rights with a controversial referendum on a new constitution. NBC's John Ray went onto the streets of Cairo to hear from both sides of the deepening divide.

What Egypt's military wants
The military, which had recoiled back to its bases after it led the country for nearly 18 months following the revolution that toppled Mubarak, remains skeptical, too.

?They have not been neutral. While appearing to be sympathetic to the protesters' demands, they remain suspicious of popular mobilization's ability to induce change that goes beyond their control,? said Joshua Stacher, a fellow at the Woodrow Wilson Center and author of "Adaptable Autocrats."

The military is also not standing on the sidelines and will likely remain the last arbiter of Egypt?s politics. Any appearance to the contrary is a result of the armed forces being ?intentionally opaque,? Stacher said.?

?I don't believe that they have a plan worked out. Rather, they are waiting to see how the situation evolves before deciding what is the best course of action,? he added.

The best course of action may just be revealing itself. The proposed constitution also stipulates that future defense ministers must be officers.

But the real test of power, Stacher and others argue, will be whether the military retains control over its vast economic empire and secretive budget under a new constitution.

?The military prefers to remain behind the curtain influencing events,? he said. ?They also have the constitution that they want in terms of securing their interests. They would prefer that the constitution pass, they stay formally out of politics, and the protesters go home.?

Actor Depardieu's Belgium move "pathetic:" French prime minister

PARIS (Reuters) - Actor Gerard Depardieu's decision to establish residency in Belgium, which does not have a wealth tax, by buying a house just over the border with France is "pathetic" and unpatriotic, French Prime Minister Jean-Marc Ayrault said on Wednesday.

Depardieu has become the latest wealthy Frenchman after luxury magnate Bernard Arnault to look for shelter outside his native country following a series of tax hikes by Socialist President Francois Hollande.

"Going just over the border, I find that fairly pathetic," Ayrault said on France 2 television. "Being a Frenchman means loving your country and helping it to get back on its feet."

The "Cyrano de Bergerac" star bought a house in the Belgian village of Nechin near the border with France where 27 percent of the population is composed of French nationals, local mayor Daniel Senesael told French media on Sunday.

Depardieu also enquired about procedures for acquiring Belgian residency, he said.

Belgian residents do not pay wealth tax, which in France is now slapped on individuals with assets over 1.3 million euros starting at a rate of 0.25 percent, nor do they pay capital gains tax on share sales. France has also imposed a 75-percent tax on incomes exceeding 1 million euros.

The tax hikes have been welcomed by left-wingers who say the rich must do more to help redress public finances but attacked by some wealthy personalities and foreign critics, who say it will increase tax flight and dampen investment.

Depardieu's move comes three months after Arnault, chief executive of luxury giant LVMH, caused an uproar by seeking to establish residency in Belgium - a move he said was not motivated by tax reasons.

The left-leaning Liberation daily reacted with a front-page headline next a photograph of Arnault telling him to "Get lost, you rich jerk", prompting luxury advertisers including LVMH to withdraw their advertisements.

Ayrault said he did not support the idea floated by some Socialist lawmakers to withdraw French nationality from people who sought residency abroad to lighten their tax bill.

"I'd rather appeal to people's intelligence, to their hearts," he said.

The long necked sauropod dinosaurs were the largest land animals ever to walk the Earth ? but why were they so large? A decade ago a team of plant ecologists from South Africa suggested that this was due to the nature of the plant food they ate, however these ideas have fallen out of favour with many dinosaur researchers. Now Liverpool John Moores University's (LJMU's) Dr David Wilkinson and Professor Graeme Ruxton of University of St Andrews, Scotland, argue that this idea still has legs.

The results have been published in the journal Functional Ecology published by the British Ecological Society this month. They suggest that this mistake happened because some scientists confused two different issues in thinking about this problem; namely how much energy is in the plant with how much nitrogen is in the plant ? the South African ideas were based on nitrogen content not the total energy in the plant food.

Dr Wilkinson and Professor Ruxton now argue that this South African idea about long necked sauropod dinosaurs being large based on the nature of the plant food they ate, is still a contender for explaining their size. As well as arguing that these ideas have been prematurely discarded the new work goes on the further develop this theory.

Dr David M Wilkinson who is an ecologist from the LJMU School of Natural Sciences and Psychology explains: "This new study makes a first attempt to calculate in more detail the implications of this idea. It suggests that it may have been to the advantage of young sauropods trying to get enough nitrogen to have a metabolism rather like modern mammals, but that this would have been impossible for the adults because of the danger of such large animals overheating from all the heat that such a metabolism would have produced."

"Alternatively - or in addition - it would also have been potentially beneficial for the young to be carnivorous, as this would also have helped them access more nitrogen. The large adults plausibly used their size to help process large amounts of plant food to access enough scarce nitrogen, as suggested in the original 2002 study. However this would potentially have caused them to have to take in more energy than they needed. A mammal (and possibly also small sauropods) would get rid of this surplus as heat, but this would not be possible for a really large dinosaur. Potentially they may have laid down fat reserves instead. So one can even speculate that they may have had humps of fat rather like modern-day camels."

Secret military space plane set to launch

The secretive U.S. Air Force X-37B robotic space plane has been cleared to lift off Tuesday.

The X-37B vehicle and its cargo bay packed with a classified payload is set to make the third mission of the program. Also called Orbital Test Vehicle-3, or OTV-3, the unpiloted craft is slated to be hurled into Earth orbit by an Atlas 5 rocket from Florida's Cape Canaveral Air Force Station (CCAFS) at 1:03 p.m. EST.

There's an interesting angle to the upcoming mission. This third flight will use the same X-37B spacecraft that flew the first test flight, the OTV-1 mission, in 2010.

That maiden voyage of the miniature space plane lasted a little over 224 days, orbiting Earth from April 22, 2010 to Dec. 3 of that year, and finally landing on autopilot at a specially prepared runway at Vandenberg Air Force Base in California. [ Photos: U.S. Military's X-37B Space Plane ]

A different X-37B vehicle made a similar Vandenberg touchdown this past June 16, after staying in orbit 469 days on its OTV-2 mission.

Accident investigation
The OTV-3 flight had been delayed for several months due to an accident investigation board looking into why a Delta 4 rocket's RL-10B-2 upper stage engine did not perform as expected on Oct. 4 during a launch that successfully orbited a Global Positioning System 2F-3 satellite.

The Atlas 5 that will hurl the OTV-3 into Earth orbit uses a different model of the Pratt & Whitney Rocketdyne RL-10 engine. However, per standard processes, the Air Force reviews all flight data to determine readiness to press forward with the next liftoff.

According to launch service provider United Launch Alliance (ULA), which makes the Atlas 5 and Delta 4, a thorough flight clearance process was executed and all "credible crossover implications" from the Delta anomaly to the OTV-3 Atlas vehicle and engine system have been thoroughly addressed and mitigated. That work culminated in the flight clearance decision for the OTV-3 launch. The investigation into the Delta rocket flight data anomaly continues.

Flight clearance
The accident investigation board concluded that a fuel leak occurred in a specific area of the interior of the thrust chamber, and that this leak started during the first engine start sequence during the October launch.

The anomaly investigation involves senior industry technical advisers, along with Air Force and NASA customers, explained Jim Sponnick, ULA vice president of mission operations, on the ULA website.

"We thank the OTV customer for their patience and participation throughout the flight clearance process for this important mission," Sponnick said.

ULA is a 50-50 joint venture owned by Lockheed Martin and The Boeing Co.

Space test platform
The X-37B program is being run by the U.S. Air Force Rapid Capabilities Office. The two space planes in the fleet ? which are 29 feet (8.8 meters) long and 15 feet (4.5 m) wide, with a payload bay about the size of a pickup truck bed ? were built by Boeing Government Space Systems.

The Air Force's Rapid Capabilities Office has a mission of expediting the development and fielding of select Department of Defense combat support and weapon systems by leveraging defense-wide technology development efforts and existing operational capabilities.

According to an Air Force fact sheet, the Rapid Capabilities Office is working on the X-37B Orbital Test Vehicle "to demonstrate a reliable, reusable, unmanned space test platform for the United States Air Force."

While both previous X-37B missions touched down at Vandenberg, the Air Force has been reviewing the prospect of landing future flights at NASA's Kennedy Space Center in Florida, next door to the Cape Canaveral launch site. Returning the robotic space plane to the KSC landing strip ? which was used by NASA's now-retired space shuttle fleet ? would lower costs, because the vehicle wouldn't have to be transported back from California to Florida after each mission.

Walter Sullivan, former Richmond bishop, dies

RICHMOND, Va. (AP) ? Former Bishop Walter F. Sullivan, a progressive leader in the U.S. Roman Catholic church and the longest-serving head of the Richmond diocese, died Tuesday. He was 84.

Sullivan, who had been diagnosed with liver cancer, died at home, said Judy Lindfors, assistant editor of The Catholic Virginian.

He spent the majority of his life serving the church, including 29 years as bishop of the sprawling Richmond diocese and 21 years before that as a priest.

As the 11th bishop to head the Richmond diocese, Sullivan was known as one of the more progressive leaders in the Catholic church. He caused controversy by opening his churches to gays and lesbians, condemning wars in Vietnam and the Middle East and speaking out against the death penalty.

Under Sullivan, women found a greater role in the church as lectors and Eucharistic ministers, and seven of the diocese's 145 parishes were run by women.

Sullivan also was instrumental in reaching out to minorities and other groups. Before he retired in 2003, the diocese had 24 advisory committees representing youth, women, homosexuals, blacks and senior citizens ? all of which he consulted regularly.

The Commission on Sexual Minorities was the first official attempt by a Catholic diocese to reach out to homosexual parishioners when it was established in 1977. While it was not instantly accepted by many in the church, there were more than 40 commissions like it 20 years later.

The commission was disbanded shortly after Bishop Francis DiLorenzo took over for Sullivan in 2004.

"The word Catholic means there's room for everyone," Sullivan told The Associated Press in an interview in 2003. "We are united in our different cultures by our common faith."

Sullivan's outreach extended to other faiths, as well. He donated $50,000 of diocesan funds to the Virginia Holocaust Museum when it was being built and sat on its board of directors.

He also helped found the Church of the Holy Apostles in Virginia Beach in 1977, a joint parish of the Catholic and Episcopal dioceses. Co-pastors conducted services at side-by-side altars ? one for Catholics, the other for Episcopalians. The idea was popular among military families who came from different backgrounds and religions.

Last month, the Richmond diocese said the church could continue to longtime practice of allowing the blended church to remain under one roof, but it ordered clergy to devise a plan to meet in separate rooms for Holy Communion.

A holdout from the liberal thinking in the Roman Catholic Church in the 1970s, Sullivan was criticized in the latter part of his career for moving too far away from the Vatican's central positions on church services and the priesthood.

Sullivan was a vociferous opponent of military conflicts. He said in a statement on the eve of war with Iraq in March 2003 that he deeply regretted "that our nation's leaders have determined that war is necessary to resolve our differences with Iraq." The diocesan office handed out black ribbons to protest the war.

He was also an outspoken opponent of the death penalty. In an interview with a Catholic wire service in 2000, Sullivan said, "They send people to death because it is like a trophy to be exhibited: the more killed, the better it is. Elections are won this way in the United States."

In the wake of the national sex abuse scandal in the Roman Catholic church, Sullivan was chastised by many for not admitting that the Richmond diocese had had priests accused of molesting children in the 1970s and '80s until after victims came forward. Three priests were ousted from the diocese in the wake of the national Catholic organization adopting new rules for dealing with allegations in 2002.

"As a bishop, he took risks to try to create an atmosphere in the church where all literally all could find their place in the Church," the Rev. Michael Renninger, now a priest at St. Mary Catholic Church in Richmond, told The Virginian-Pilot.

Sullivan was born in Washington, D.C., in 1928 and received his seminary education at St. Charles College and St. Mary's Seminary in Baltimore.

He was ordained as a priest for the Diocese of Richmond in 1953 and received a degree in Canon law from Catholic University in 1960.

In 1970, Sullivan was ordained as auxiliary bishop for the Richmond diocese; four years later, he was installed as bishop.

Sullivan took mandatory retirement in 2003 at the age of 75.

The Diocese of Richmond is one of the oldest in the country, established in 1820 from part of the Archdiocese of Baltimore. The diocese is home to 220,000 Catholics, and stretches from Virginia's Eastern Shore to Cumberland Gap on the Tennessee and Kentucky borders, a distance of 535 miles.
